Essay for maritime law Example | Topics and Well Written Essays - 1500 words

For maritime law - Essay Example First, let us consider the case of Barrack. Barrack was merely a buyer of vodka and it was meant for presidential election. He had accepted the offer made by Dimitry and had undertaken to bear the profit or loss as expected from the trading point of view. But since the good was not yet delivered to Barack, he can definitely claim compensation, but that is subject to the deal he had with Dimitry. Maritime law is actually an aspect of the international law and cannot be considered a municipal or domestic law. The international aspect of the maritime law can never be denied and it gives it a distinctive flavor. In the doubtful cases the court of one country will look into the examples or rulings of another country for the requirement of idea or assistance. Except to the degree that it is bound by the international conventions like Hague, each country can adapt to the maritime law that think is favorable. Hence, what maybe valid for Russia, may not be applicable for USA and vice versa. But since the bill of lading is considering the U.S. law hence, it can be considered that Barrack will have a definite advantage. In many cases the pilot effort has been made by the International Maritime Committee, which is more commonly known ass Comità © Maritime International (CMI). This contains the maritime law associations of about 30 nations. The work of the committee is to primarily draft the international conventions which relate to the subjects of maritime law. When these drafts are prepared it is then submitted to the government of Belgium which then holds a diplomatic conference and this draft is discussed and amended as per the requirement of the international maritime trade. These regulations are an international system of navigation. In extra fields a lot has been achieved in order to guarantee the international consistency through the confidential agreements willingly adhered to by the affected parties; the

Measles Outbreak in America Research Paper Example | Topics and Well Written Essays - 2000 words

Measles Outbreak in America - Research Paper Example Reasons for Vaccination It is difficult to comprehend why any person would want to halt or slow such progress, but maybe it is due to the misinformation of such individuals that forces people to ignore the effects of non-compliance. For starters, there is no definite treatment for measles. The only things that can be treated are the symptoms that are brought on by measles. During the post-eradication phase of measles, the highest number recorded for measles cases was as low as 37. This is according to the CDC, which was responsible for vaccinating the American public against the spread of the disease. Even the cases that were present had originated from outside the country. Since then, America is now recording its highest number of cases, which was estimated at over 600 cases at the end of the year 2014. In January 2015, over 100 cases were reported. In terms of vaccination, one dose of the MMR vaccine can last an individual a lifetime. It is meant to protect against measles, mumps, and rubella. The use of this vaccine has increased the reduction rate of measles cases by 99%. For a highly contagious disease, this is an incredible number, meaning the eradication of this disease is possible. The aim of vaccination is to elicit certain responses in the immune system, which are often similar to when one is infected with the measles pathogen. In response, the immune system produces antibodies that fight against the disease, which means the individual vaccinated does not build up any severe symptoms.

Stop smoking Essay Example for Free

Stop smoking Essay Whether you’re a teen smoker or a lifetime pack-a-day smoker, quitting can be tough. But the more you learn about your options and prepare for quitting, the easier the process will be. With the right game plan tailored to your needs, you can break the addiction, manage your cravings, and join the millions of people who have kicked the habit for good.Smoking tobacco is both a physical addiction and a psychological habit. The nicotine from cigarettes provides a temporary, and addictive, high. Eliminating that regular fix of nicotine will cause your body to experience physical withdrawal symptoms and cravings. Because of nicotine’s â€Å"feel good† effect on the brain, you may also have become accustomed to smoking as a way of coping with stress, depression, anxiety, or even boredom. At the same time, the act of smoking is ingrained as a daily ritual. It may be an automatic response for you to smoke a cigarette with your morning coffee, while taking a break from work or school, or during your commute home at the end of a long day. Perhaps friends, family members, and colleagues smoke, and it has become part of the way you relate with them. To successfully quit smoking, you’ll need to address both the addiction and the habits and routines that go along with it.While some smokers successfully quit by going cold turkey, most people do better with a plan to keep themselves on track. A good plan addresses both the short-term challenge of quitting smoking and the long-term challenge of preventing relapse. It should also be tailored to your specific needs and smoking habits.

Some Reasons For Unhappiness

Some Reasons For Unhappiness The true American dream of the pursuit of happiness might now directly change into the pursuit of material wealth because some people are becoming unhappy. I assume our immeasurable desires make us unhappy. Psychologists define unhappiness as a mental or emotional state of distress that is distinguished by negative or upset emotions fluctuating from contentment to intense misery. I started my journey reasons for unhappiness, by interviewing some Montgomery College students, and I continued interviewing many other people: my friends, co-workers and relatives. Then, I did some research and watched a great documentary film called HAPPY and some more videos from websites to strengthen my case. Next, I examined people different reasons and views for their unhappiness. The first reason is seriousness of their unhappiness. Some people are not happy because they have extra weight on their body, and others are unhappy because they lost someone they deeply love. Also, they have complex reasons from one another. Some people believe they hate their job because they dont have enough money to afford what they want to buy. Others are not happy because they dont have a job. Health is also another concerning reason. Some people are unhappy because they dont have good health and others are not happy because they dont have money to buy cigarettes. After I studied different types of unhappiness, I found out people can become unhappy in two different ways. One way to be unhappy is having bad relationships among families, co-workers and friends. Another way is having personal problem, such as health. There are also several ways to become happy. These can be reading the Holy Bible, traveling aboard and learning about different cultures, creating great social interaction with your neighbors, or building freedom of choices. Introduction Pressures we carried in our lives can produce destinations for our happiness or unhappiness, such as a final exam for a student, an interview for a job seeker, an experiment for a scientist, or a touchdown for a football player. These conditions are major deciders for our happiness or sadness. Even though it is obvious that every one of us seek a single outcome -joy, there are still many reasons for unhappiness. I believe our happiness can be achieved by feasible dreams or heart desires, but not unobtainable dreams that put us into miserable situations. My assumption is limitless desires for everything we could ask for and even more have made us to not appreciate life and to no be happy. During my study, I found several reasons and research papers about unhappiness, but I mainly focused the dimension, complexity or differentiate, and unhealthiness of unhappiness to support my hypothesis. In this trying research, my goal is study the danger of unhappiness and its consequences and to find recommendations that fulfill a person life with full of happiness. In addition, the purpose of this report is to scrutinize or avoid our unhappiness because I believe it may cause demise. I have included some people life experiences and interviews and expert analyses. Methods According to Ian Sample article, How to be happy? the Guardian newspaper in November 2003, most of us are born with a certain amount of happiness, and our happiness is a best way to achieve our goals. However, unhappiness has been an endless problem for most individuals. Thus, I started by interviewing to proof my assumption. I interviewed some Montgomery Community College students, my friends, my families, and my co-workers, and all the interviews was fun, and besides it helped me to get supportive evidences. After I had numerous interviews, I watched a one and half hour documentary film called HAPPY, directed and written by Roko Belic, on Netflix. The documentary has an extraordinary journey from small town India to the modern city Japan in pursuit of happiness. Also, it has actual life stories of individuals from around the world and influential interviews with some top experts and scientists. It also explores the secrets behind our most valued emotion, happiness. I watched the documentary many times, and I carefully took a note about why people are happy or unhappy. Next, I composed some information about happiness from different website articles, such as the Guardian daily newspaper. In addition, I watched several videos, on TED.com, about happiness and unhappiness, which help me to prove my hypothesis come up with strong conclusion and recommendation. Results Depths of unhappiness Nancy Etcoff, a professor of the science of Happiness at Harvard university, in her talk, Happiness and its Surprises on ted.com, explained that humans are very sensitive of negative things; hence, they can easily be unhappy. During my study, I mainly focused on the profundity of unhappiness because some people unhappiness was a slight lower-amid gloom. For instance, they were unhappy because they got a parking ticket while parking in No Parking! areas. I tried to avoid this common and ordinary unhappiness, which have easy solutions. For instance, if someone is unhappy about his weight, he can exercise. Also, it was pretty difficulty for me to record consultations about unhappiness. While I was fully concerning to get a negative life experience, some people I interviewed were giving me a commonplace sadness because they concerned about protecting their depressed stories. In general, the majority of my interviewer stories were very common unhappiness. They were simply unhappy in particular situations and overlooked it right away. However, some have emotionally wounded for long period of time, which allowed me to see how unhappiness deeply affected people lives. One of my good friends told me about his agonizing marriage story, and how it affected his life. He told me that he found his wife cheating; however, he has been willing to keep his relationship for the sake of his children. Even though he is still unhappy about it, he mentioned that he fears if he wanted a divorce, he will lose his children. As a result, he chooses to be unhappy and lives with his children than getting divorce. Complexity of unhappiness In my study, I also found that unhappiness can have a different involvedness between ages and situations. For instance, My nephew, age 10, want to play game during weekend if he didnt allowed to play a video game in weekends, he would be unhappy. And, some college students believe that they are not happy because of some bad professors. Their repulsions are even though they have a good or bad grade, they are not happy by the way they are learning in some classes. However, some other college students have different ideas, they believe that the reason why college students are unhappy because of stressful college course, which has various pressures and expectation, and most time these prevent students to earn good grades. Also, my co-workers have different explanation for their unhappiness. Most of my co-workers think they are not happy because of low payment in the company. In contrast, my unemployed friends feel miserable because they couldnt find a job. How unhappiness impact a person health? During my interviews, some people give me feedback of unhappiness concerning to heath. They said that when they feel like there are too many pressures or demands on them, they become stressful. For instance, when they are worrying about tests and schoolwork, they might lose sleep. When they have busy schedules, they might eat on the run. Also, everyone experiences stress at times; adults, teens, and even kids, but there are ways to minimize or to manage those health problems. However, not like the following story. Markus, my co-worker in JCP, told me a poignant story of his ex-girlfriend. He told me that his ex-girlfriend became drug addicted because she was unhappy in her life. When she took drugs, she felt false happy. Thus, she continued to use drugs because if she didnt take drugs, she believed she would have a stressful day. Markus was unhappy by her situation and he tried to stop her for several months. However, she couldnt listen to him. Finally, she ended up death while taking drugs. Discussion During my study of reasons for unhappiness, I found out about two ways of unhappiness which support my hypothesis: one there is dependent unhappiness, and there is independent unhappiness. Dependent unhappiness is unhappiness that we feel when we lost what we had. For instance, if suppose we keep expecting from others: friends and co-workers including our relatives, we finally end up unhappy because people are capable of making mistake. Daniel Kahneman on his talks, The Riddle of experience vs. memory on ted.com, explained even though every one of us want to make happy one and another, still people are becoming unhappy because what other people did to them. Independent unhappiness is melancholies that happen when we have desire that has never-ending. For instance, when we comparing ourselves to others. When we want more of something things weather it is bad or good. We are not pretty skillful about thinking quickly before we act, so we need not be disgraceful about our own deeds. If we can solve problems in our life then there is no need of worry, but we still deeply stressed and become unhappy plus hurt our health with the thing we cant solve. During my studies, I have perceived whether it is dependent or independent unhappiness, people are becoming unhappy because they dont have a limit for things. Most of our unhappiness came from the unrestricted desire of achievements. We should have to know our capabilities and potential what wed, and has to keep little expectations from others as much little as possible also from ourselves. Even though our unhappiness is bring those various types of problems and different reasons. Some reasons are depth and some are easy, and some reasons are complex and have health issues. Recommendation to become happy They are many recommendations for our unhappiness. J.D. Roth, a founder of award-winning website Get Rich Slowly, in his article, The Psychology of Happiness: 13 Steps to a Better Life, on GetRichSlowly.org, has recommended how to avoid unlimited desires and some step for a better life. Also, he mentioned that people should not compare physically or socially to one another, and to focus to their personal goals. In addition, getting away of unhappiness might have different recommendations, but all have the same impact, which is becoming happy again. No one ever found happiness alone, gazing at his navel. Happiness is not personal. It is relational. If we improve our relationships, we will surely boost our happiness. Thus, traveling aboard and exploring new things, becoming closely connected or associated with neighborhoods are some of freedom of choice: doing what someone loves to do and knowing limitation: avoiding life pressures can help us to get away from unhappiness. Pros and Cons of Becoming a Cyborg: Trading Flesh for Metal :: Exploratory Essays Research Papers

Pros and Cons of Becoming a Cyborg: Trading Flesh for Metal Since the beginning of time, man has attempted to avoid the inevitable. In his endless pursuit of perfection, man has tried to dodge the grim reaper. Death is certain; life is not. Yet through technological interventions, man is attempting to be godlike and live eternally. Through these same interventions, man is becoming transformed into a cyborg. Currently, the technology has not arrived so that a man will be able to have more metal in his body than he would have flesh. But if one could be a cyborg , if one could live longer, jump higher, store more info, and become more efficient would they? Would one become a cyborg if it meant no more pain, no more suffering, but in exchange would require thousands of dollars worth of hardware and hundreds of hours’ worth of surgery. Today I will explore some of the pros and cons of becoming a cyborg. I will also explore how people today like Stelarc have already taken steps and modified their own bodies to become cyborgs. I wi ll also define some of the ethical and morals issues supporting and criticizing the transformation from flesh to metal, with the end result becoming a cyborg. First of all, one must define what a cyborg is, and also clearly define what a cyborg consist of. A cyborg is a combination of man and technology. Robocop, The Terminator, Spock are all clear examples of what a cyborg is. A cyborg is a combination of human life and artificial intelligence. What about the elderly, would they be considered cyborgs? Yes, with pacemakers surgically installed within their bodies, the elderly, according to the definition, are considered to be cyborgs. So then, what the hell is a cyborg? One may believe the best place to locate a definition is the Webster’s New World Dictionary; it defines cyborgs as â€Å"a hypothetical human being modified for life in a hostile or alien environment by the substitution of artificial organs and other body parts. Using the basic definition will not be enough, it is too broad. One cannot really determine what a cyborg is and what a cyborg is not. For instance, suppose if people followed this definition that would mean that anyone wearing a watch, contacts, glasses, or using headphones would be considered a cyborg.

Process Safety Management in the Oil and Gas Industry

Abstract This paper provides a discussion of process safety management applied to the global oil and gas industry. The importance of maintaining regular risk assessments and environmental impact assessments has been indicated upon the completion of this research. The focus of the study is on integrating different management tools, such as EIA and HSE-MS, to evaluate the potential risks pertaining to development projects in the oil and gas industry. In addition, the report explores specific lessons learned from the defence industry, indicating that HSE management systems may be effectively applied to the oil and gas industry as well. Introduction The occurrence of various incidents and hazards occurring in the oil and gas industry is quite frequent, thereby necessitating the adoption of effective and reliable measures to mitigate such risks (Ovind and Sneve, 2004). It has been argued that Health, Safety and Environment Management Systems (HSE-MS) have a positive impact on the functioning of global oil and gas companies considering the high level of accuracy of assessments provided by this management tool (Bergh et al., 2014). The objective of the present report is to explore the feasibility of process safety management in the oil and gas industry. Process Safety Management in the Oil and Gas Industry Significant aspects can be learned in improving human factors in the oil and gas industry from industries, such as aviation, nuclear power and defence. However, the oil and gas industry demonstrates specific challenges that can make it difficult to apply design process and standards that have led to positive results in other industries (Ramirez et al., 2013). The development of various processes and standards has adhered to meet the needs emerging in the global oil and gas industry. Scientific research extensively focuses on the psychology of how irrationality and cognitive biases may lead to inadequate risk assessment and improper decision-making processes. Thus, the necessity to create practical and simple solutions is urgent than ever (Bergh et al., 2014). The introduction of Health, Safety and Environment Management Systems (HSE-MS) is important part of this process. Basic elements of HSE-MS include commitment to appropriate leadership practices, setting of clear goals and objectives, and undertaking strict risk evaluation and control procedures (Ash, 2010). When organisations in the oil and gas industry adhere to these aspects of their overall management, positive results can be expected in the long term. Communication among all divisions of organisations should be ensured in order to meet the expectations of all stakeholders in the industry. Management should provide commitment and personal involvement in health, safety and the environment as a whole (Zimolong and Elke, 2006). A proper expectation that could be indicated relates to setting a personal example of following major HSE rules. The decisions that could be made should consider aspects of quality, cost, morale, and production. In the process of introducing HSE principles in the oil and gas industry, it should be pointed out that allocation of resources should be done effectively in an attempt to carry out some of the most important functions of HSE. The development of local HSE policies should be in line with corporate objectives and standard as relating to the oil and gas industry (Ramirez et al., 2013). Setting objectives for continuous improvement should be the focal point of introducing such policies. All levels of management should be involved in similar processes to achieve optimal efficiency and productivity. In addition, certain objectives should be developed to mitigate risk within organisations operating in the oil and gas industry. The stage of risk evaluation and management should be consistently introduced in oil and gas companies in order to adhere to major HSE management guidelines that may contribute to decreasing the risk of incidents in this industry (Zimolong and Elke, 2006). This step i s associated with the establishment of a proper methodology that outlines acute and chronic hazards including their perceived effects. Moreover, it is important to conduct flexible hazard assessments at the design, development and operating stages. The application of risk management tools may significantly facilitate the process of achieving of the set policy objectives. It has been identified that an effective legislative programme requires three essential dimensions: powerful and well-resources regulations, setting accountability parameters to drive appropriate behaviours in the industry, and ensuring solid industry support (Berg et al., 2014). The globalisation of HSE issues for the oil and gas industry should be explored in order to demonstrate a process of setting high standards of performance in the field. In 2011, the European Commission released a series of legislative proposals to guarantee offshore safety (Ramirez et al., 2013). The focus on preserving the natural environment has been properly maintained. HSE policies are expected to cover oil spill and emergency response preparedness, quality assurance and management systems. The utmost goal of similar initiatives is to ensure a healthy and safe environment for employees in oil and gas companies as well as for residents of different countries (Ash, 2010). The conduct of particular operations from the oil and gas industry should be done with the consideration of strict professional standards for safety. In fact, the safety of employees should be taken into consideration as well as the environment and economic values. In general, oil and gas companies are committed to developing of proper systems for monitoring of their technical facilities and plants. The occurrence of various incidents in the industry, such as the Macondo incident, the US Department of the Interior undertook drastic measures in 2011 to mitigate risks in this sector (Haight, 2013). Two new agencies were created to monitor a series of operations and activities in the Gulf of Mexico, as these are the Bureau of Safety and Environmental Enforcement (BSEE) and the Bureau of Offshore Energy Management (BOEM). In addition, the Department was responsible for issuing new and more effective regulations to address the specific roles and functioning of these two agencies (Bergh et al., 2014). Product specifications along with emission controls and climate change programmes have contributed to the development of proper and highly effective HSE systems. It can be suggested that these aspects can have a significant impact on the production and profitability of different products introduced by oil and gas companies. Moreover, there are certain environmental laws that require organisations that operate in this industry to restore all areas in which particular incidents or unauthorised release of various hazardous materials have taken place. It can be anticipated that HSE laws and regulations can have a rather positive impact on the operations of oil and gas companies (Zimolong and Elke, 2006). However, it may be challenging to indicate what would be the potential future effects of certain legislations adopted in the context of the global oil and gas industry. There may be risks associated with HSE costs and liabilities, which may be evident in the activities of global oil and gas companies. Thus, such organisations recognise the importance of implementing solid HSE standards and management tools to facilitate the accomplishment of certain outcomes (Ash, 2010). One of the legislative frameworks that provide substantial information on applying HSE standards in the oil and gas industry is the IADC HSE Case Guidelines. These guidelines â€Å"provide a framework for developing an integrate health, safety and environmental management system for use in reducing the risks associated with offshore and onshore drilling activities† (International Association of Drilling Contractors, 2014). The significant of the guidelines reflects in the adoption of high standards that can help in increasing global health, safety and environmental awareness in relation to the oil and gas industry. The worldwide acceptance of the guidelines in countries such as Australia, Canada, South Africa and Cuba implies their universal applicability to solve emerging challenges in the respective industry (Ash, 2010). The need to assist regulatory authorities around the world may contribute to the delivery of standards and principles that are closely tailored to correspon d to the needs of oil and gas companies. Emphasis is put on reassuring that the most proper industry practices have been implemented in terms of health, safety and environmental concerns. Lessons from the Nuclear Power of the Defence Industry Thus, the focus can be shifted to learning important lessons from the nuclear power of the defence industry. One of the crucial lessons learned so far is that of interaction considering that different legislations throughout the world may demonstrate the adoption of similar approaches to mitigate risks in the oil and gas industry (Bergh et al., 2014). Interaction emerging at all stages of the assessments is important to make sure that all needs of the stakeholders in the industry are met. Another lesson that can be learned from the defence industry and applied to the oil and gas industry relates to access to information. It is essential to understand that particular parts of the development projects may contain classified information (Zimolong and Elke, 2006). Such details may be significant in the process of carrying out the intended assessment procedures. Timing also is a valuable lesson that can be drawn from the defence industry in terms of focussing on all points during the proj ect planning stage. It should be initially noted that assessments involving EIA and HSE-MS tools serve as an adequate decision support system that should be available in a timely manner. Analysis of Human Failure Contribution to Process Risk In order to gain understanding of human reliability and accident causation, it is important to focus on various HSE management tools including HAZID, HEMP and HAZOP. One of the most powerful tools for the identification of major hazards and risks, which can be implemented in the global oil and gas industry, is HAZID (Ovind and Sneve, 2004). Its use is recommended to be done early to demonstrate greater precision and accuracy of results. The key benefits of HAZID include fast identification and correction of potential deviations, providing records of hazards to avoid and mitigate further risks in the global oil and gas industry (Rausand, 2013). The method actually represents a design-enabling tool used to enhance the HSE parameters in particular projects. Furthermore, the Hazards and Effects Management Process (HEMP) was designed to present a highly structured approach to analysing various hazards in the life cycle pertaining to installation processes in the industry. This method refers to a three-day session in which participants are provided with significant information on risk management and essential HEMP principles, including HEMP’s role in the HSE management systems (Bergh et al., 2014). The management tool identified as HAZOP has been also found useful in identifying and mitigating risks pertaining to the global oil and gas industry. The initial use of this instrument has been considered for the proper identification of hazards through flowsheets and diagrams. It also implements safety audit after several months of operation (Rausand, 2013). Specific procedures considered by oil and gas companies refer to determining the precise degree of hazard and expected change as well as a consideration of the worst case accident th at may occur as a result of the modification. In addition, the management tool requires the appointment of a competent, qualified person to comply with the strict requirements for HAZOP (Ramirez et al., 2013). Case Study of Operating Events at Commercial Nuclear Power Plants However, it is important to focus on the aspects of human failure contribution to process risk as applicable to various events that take place at power plants. The main tools that have been implemented to identify safety events, in which human failure contribution to process risk was investigated, refer to the Nuclear Regulatory Commission (NRC) Accident Sequence Precursor (ASP) Program and the Human Performance Events Database (HPED). Events in this case were selected on the basis of SPAR analyses that contributed to a proper estimation of human errors that eventually increased risks to the completion of these events (Rausand, 2013). In addition, different human error categories and subcategories have been identified to demonstrate greater accuracy of findings. The formation of categories took place in line with their frequency of occurrence (Gertman et al., 2001). Major categories included command, control, resource allocation, operator actions, communications, design deficiencies, design change testing, configuration management, as well as procedures of maintenance and monitoring of various work processes (Zimolong and Elke, 2006). It has been argued that human failure substantially contributed to process risk in relation to operating events. For instance, seven human errors have been identified to contribute to the emergence of numerous event failures in the identified power plants. Another challenge that has been observed in this case study referred to the lack of attention to recurrent problems (Ash, 2010). In fact, the lack of attention and care to recurrent problems was estimated in approximately 41% of the operating events (Gertman et al., 2001). Such inattention mostly related to improper NRC inspection findings, industry notices, and vendor notices. Operating with known design deficiencies also created certain problems at the commercial nuclear power plants. Human failure was evident in the inability or error to follow plant and industry trends as well as provide timely responses to industry notices (Ramirez et al., 2013). Active human errors were identified as quite problematic pertaining to command and control and resource allocation failures, amounting to almost 28%. For instance, it has been indicated that command and control between Oconee Unit 2 1992 and Keowee hydroelectric station turned out to compromise or challenge the response from the plant (Gertman et al., 2001). The tasks performed by Keowee staff seemed to have affected emergency power at Oconee without receiving proper notifications from control room management. This is a clear example of how human failure contributed to increased risks of operating events. In this relation, it is essential to separate human actions in pre-initiator categories and post-initiator categories (Rausand, 2013). Pre-initiator actions are recognised as actions that may affect the availability of systems and elements associated with the response to incidents. Such actions mostly include errors in restoring particular systems after maintenance procedures at the plants (Zimolong and Elke, 2006). Post-initiator human actions represent a type of responses to incidents occurring in the power plants, as they may be also recovery actions in terms of restoring certain failed systems. It can be suggested that latent human errors mostly suppose a direct relation with pre-initiator human actions, as they are further related to numerous failures in the system. Therefore, it can be concluded that the results obtained from this case study indicated that human performance contributed essentially to increasing risks in analysed operating events (Bergh et al., 2014). Human failures to correct known problems have been frequently identified along with errors made during design and maintenance activities at commercial nuclear power plants. Thus, the results of this case study demonstrate that multiple errors occurring in operating events contribute to the so-called probabilistic risk assessment (PRA) basic events which are evident in SPAR models (Gertman et al., 2001). Importance of EIA and HSE-MS In order to improve practice of the oil and gas industry, the introduction of HSE management systems should take place in line with the integration of Environmental Impact Assessment (EIA). It is essential to clarify that EIA is defined as a process by which a project’s impact on the environment is measured (Department of the Environment, Community and Local Government, 2013). In case the likely effects are identified as unacceptable, professionals in the field are responsible for developing effective mitigation strategies to reduce such a perceived negative impact. Thus, EIA is a crucial tool used in managing the complex interrelations between development and the environment (Rausand, 2013). The examination of the environmental consequences of development actions is done in a structured manner based on multidisciplinary approaches applicable to the global oil and gas industry. The integration of EIA and HSE-MS tools may adequately facilitate the functioning of oil and gas com panies. The primary goal of these management tools is to ensure strict compliance with relevant legislations and standards in the field of operation (Bergh et al., 2014). It is of crucial importance that all HSE hazards are identified and handled in a timely manner. Their systemic assessment is a proper step towards ensuring that all criteria for adequate performance have been met. The integration of these assessments allows for accurate procedures implemented in the context of risk management for oil and gas companies worldwide. For instance, it may be indicated that various development projects that involve the use of radioactive material and nuclear fuel represent serious risks and hazards, which should be extensively assessed through the frameworks of EIA and HSE-MS (Abaza et al., 2004). Global oil and gas companies are held responsible for ensuring that all dimensions pertaining to human health, environment and security are thoroughly considered prior to the accomplishment of particular projects. Thus, importance is placed on risk assessment and environmental impact assessment of planned activities in the oil and gas industry (Rausand, 2013). As a result, such organisations are committed to improve their internal procedures that play a key role in conducting risk assessment and environmental impact assessment. In this context, a viable measure would be to screen all nuclear safety project proposals to ensure that such assessment procedures are done appropriately. Additional requirements for compliance may be specified by the authorities in particular countries in which oil and gas companies operate (Ash, 2010). International measures should be constantly improved in relation to the integration of EIA and HSE-MS measures (Zimolong and Elke, 2006). This aspect may lead to extensive support for initiating a co-ordinated international action to demonstrate high-quality environmental impact assessment and risk assessment pertaining to projects developed in the oil and gas industry. An overall risk assessment is fundamental in order to ensure that all development projects are completed in a cost-efficient and secure manner. These aspects should be considered in the process of setting certain priorities in the operation of oil and gas companies (Ramirez et al., 2013). Such thorough assessments may direct efforts to generate necessary funds for the completion of more urgent tasks in the industry. Conclusion In conclusion, this paper provided a relevant exploration of process safety management in the global oil and gas industry. Specific arguments have been introduced in order to emphasise the important role of HSE-MS tools, which combined with EIA, may contribute to greater efficiency and safety of work practices in oil and gas companies around the world (Rausand, 2013). The paper focuses on discussing the effectiveness of HSE management systems. In addition, human failure contribution was analysed as related to process risk evident at operating events in commercial nuclear power plants. Another aspect outlined in the report included the integration of EIA and HSE-MS tools that may lead to better recognition and maintenance of risks identified in the oil and gas industry (Bergh et al., 2014). In conclusion, providing accurate assessments is associated with the delivery of positive outcomes in this industry. References Abaza, H., Bisset, R. and Sadler, B. Night World : Soulmate Chapter 9

You'll change your mind,† Thierry said. An instant later everything was chaos. Thierry had one hand in her hair, twisting her head to the side, exposing her neck. His other arm was keeping both her arms trapped against her body. Hannah was twisting, struggling-and it wasn't doing any good. He was unbelievably strong. She felt the warmth of breath on her neck . .. and then the sharpness of teeth. â€Å"Don't fight.† Thierry's muffled voice came to her. â€Å"You'll only make it hurt worse.† Hannah fought. And it did hurt. The pain of having blood drawn out against her will was like nothing she'd ever felt. It was as if her soul was being pulled out of her body, a pain that radiated down her neck and through her left shoulder and arm. It turned her vision gray and made her feel lightheaded. â€Å"I-hate-you,† she got out. She tried to reach for him with her mind, to see if she could hurt him that way . . . but it was like running up against an obsidian wall. She could feel nothing of Thierry in the contact, just smooth black hardness. Forget about that, the cool wind voice said. And don't faint; you've got to stay conscious. Think about your room. You need wood; you need a weapon. Where†¦ The desk. Even as she thought it, Thierry's grip on her was shifting. He was forcing her to turn so she faced away from him, still holding her in an iron grip with one arm. She had no idea what he was doing with the other arm until he spoke again. â€Å"I have to give you back something for what I took.† And then the other arm was in front of Hannah, wrist pressing to her mouth. She still didn't really understand-she was dazed with pain and loss of blood-until she felt warm liquid trickling into her mouth and tasted a strange exotic taste. Oh, God-no. It's his blood. You're drinking vampire blood. She tried not to swallow, but the liquid kept flowing in, choking her. It didn't taste at all like blood. It was rich and wild and burned slightly-and she could almost feel it changing her. You've got to stop this, the cool wind voice told her. New. With a violent wrench that almost dislocated her shoulder, Hannah got one arm free. Then she started to fight hard, not because she wanted to get away, but because she wanted to keep Thierry occupied in holding her. While they were struggling, she surreptitiously reached out with her free hand. I can't feel it. She threw her body back and forth, trying to get Thierry to move closer to the desk. Just a little farther†¦ there. There! Her fingers were on her desk. She stomped on Thierry's foot to keep him distracted. She heard a snarl of pain and Thierry shook her, but her fingers kept groping across the desk until they found something smooth and long, with a pointed graphite end. A pencil. Hannah curled her fingers, gathering the pencil into her fist. She was gasping with effort, which meant more of the strange blood was flowing into her mouth. Now think. Visualize his hand. Picture the pencil going right in, all the way through. And now strike. Hannah brought the pencil up with all her strength, driving it into the back of Thierry's hand. She heard a yelp of pain and outrage-and at the same instant she felt a stab of pain herself. She'd driven the pencil all the way through his hand and jabbed her own cheek. She didn't spend time worrying about it. The iron grip on her had loosened. She slammed a foot into Thierry's shin and spun away as he jerked back. The desk! You need another weapon! Even as the voice was telling her, Hannah was teaching for her desk, gathering a random handful of pens and pencils. Thank God for her habit of losing pencils, which was the reason she had to keep so many. As soon as she had them, she twisted to dart across the room, getting her back to a wall. She faced Thierry, panting. â€Å"This next one goes right into your heart,† she told him, pulling one pencil out of the handful and holding it in her fist. Her voice was soft and ragged, but absolutely deadly in its conviction. â€Å"You hurt me!† Thierry had pulled the pencil out and was staring at the wound. His face was contorted, his eyes blazing with animal pain and fury. He looked like a stranger. â€Å"Right,† Hannah said, panting. â€Å"And if you come close to me again, I'll kill you. That's a promise. Now get the hell out of my house and out of my life!† Thierry stared back and forth from her to his hand. Then he snarled-really snarled, his upper lip lifting, his teeth bared. Hannah had never seen a human face look so bestial. â€Å"You'll be sorry,† he said, like a child in a temper tantrum. â€Å"And if you tell anybody about this, I'll kill them. I will. It's Night World law.† Then he did the fade-out thing. Hannah blinked and he wasn't there. He must have backed up down the hall, but she didn't hear a door open or close. It was several minutes before she could loosen her grip on her pencil or step away from the wall. When she could, it was to stumble toward the phone. She pressed the speed dial for Chess's number. Busy. Hannah dropped the phone. She was swaying on her feet, feeling sick and giddy, but she headed for the dining room. There, keeping one of the windows shut, was a wooden dowel, the remnant of some long-past safety craze of her mother's. Hannah broke it over her knee and carried one splinter-ended piece with her to the garage. The dusty old Ford was parked there, the one her father had driven before he died. Hannah found the keys and started for Chess's house. She could think of only one thing: she didn't want to be alone. Gray spots danced in front of her eyes as she drove. She kept imagining things rushing at her from the prairie. Stay awake. Just stay awake, she told herself, biting her lip hard enough to draw blood. There! There's the house up ahead. You can see the light. All you have to do is get there. She stepped on the accelerator. And then everything went gray. Thierry looked around the resort lobby, then glanced at his watch. He'd been doing that every five minutes for about the last twelve hours, and his nerves were starting to fray. He didn't like leaving Hannah alone. Of course, the ring would protect her when she was away from the house, and the amulet he'd buried in her backyard would protect the house itself. It was a strong amulet, made for him by Grandma Harman, the oldest and most powerful witch in the world, the Crone of the Inner Circle. It set wards around the house, so that no Night Person could enter without a direct invitation from somebody who lived inside. He still didn't like leaving Hannah alone. Only a little while longer, he told himself. It had ‘taken him most of last night and all of today to call in enough of his own people to set up a plan for watching over Hannah. She'd told him to go away, and he had. Her word was law to him. But that didn't mean he couldn't have her guarded. She need never realize that there were Night People around her, watching and waiting in the shadows-and ready to fight to the death if any danger appeared. Lupe had been right. He couldn't deal with this alone. And now he was going to have to rely on other people to keep Hannah safe. Thierry looked at his watch again. It was nine o'clock at night, and he was almost tempted to give up on Circe. But only a witch of her power could set up the kind of heavy-duty wards that would protect Hannah wherever she went in Amador County. He kept waiting. As he did, he stared at a gun rack on the wall and tried to keep his brain turned off. It didn't work. Ever since he'd awoken Hannah from her hypnotic trance, he'd been trying very hard not to think about the old days. But now, he found himself being irresistibly drawn back-not only thinking about them, but reliving them. Traveling back in his mind to the stupid young man he had been†¦. He hadn't been the first vampire. He didn't have that distinction. He had only been the second. He'd grown up in the tribe of Maya and Hellewise. The Maya and Hellewise, the twin daughters of Hecate Witch Queen. The Maya and Hellewise who would go down as the two greatest figures in Night World history; Hellewise Hearth-Woman as the ancestress of the Harman family, the most famous of the living witches, and Maya as the ancestress of both the lamia and the made vampires. But of course he knew nothing about that at the time. All he knew was that they were both pretty girls. Beautiful. Hellewise had long yellow hair and deep brown eyes. Maya had long black hair and eyes that glittered in different colors like the changing lights in a glacier. He liked both sisters very much. Maybe that was his downfall. He'd been a very ordinary fellow, with a good throwing arm, a delicate touch in carving ivory, and a vague longing to see the world. He'd taken it for granted that his tribe was special, that they could influence the weather and summon animals from the forest. They were the witch people, they'd been granted special powers, and that was all. It wasn't anything to worry about. And, like everyone else, he knew that Maya was doing experiments in the forest, using her powers to try and become immortal. But that didn't worry him particularly either†¦. I was very young and very, very stupid, Thierry thought. That had been the real downfall of the tribe. Maya's desire to become immortal. Because she'd been willing to pay any price for it, even to the point of becoming a monster and leaving a curse on all her descendants. Maybe if Thierry and the other witch people had realized that, they could have stopped her before it happened. Because Maya had finally found the right spell to achieve immortality. The problem was that to do it, she had to steal the babies of the tribe. All four of them. She took them out to the forest, did the spell, and drank their blood. Thierry and the rest of the tribe found the four little bled-out bodies later. Hellewise had cried all night. Thierry, who couldn't understand how the pretty girl he liked could have done something so awful, cried, too. Maya herself had disappeared completely. But a few nights later she came to Thierry. He was keeping watch outside the cave when she appeared silently beside him. She had changed. She wasn't the pretty girl he knew anymore. She was stunningly, dazzlingly beautiful. But she was different. She moved with the grace of a nighttime predator, and her eyes reflected the firelight. She was very pale, but that only made her more lovely. Her mouth, which had always been soft and inviting, seemed red as blood. And when she smiled at him, he saw her long pointed teeth. â€Å"Hello, Theory,† she said-that was his name back then. â€Å"I want to make you immortal.† Thierry was scared out of his mind. He had no idea what she'd become-some weird creature with unnatural teeth. But he knew he had no desire at all to be like her. â€Å"I really think it's unfair, the way you go back and forth between me and Hellewise,† she said casually, sitting down on the bare earth. â€Å"So I've decided to resolve the question. You're going to be mine, now and forever.† She reached out and took his hand. Her fingers were very slender and very cold-and unbelievably strong. Thierry couldn't pull away. He stared at his hand with his mouth open like the idiot he was. This was the time he should have started yelling, thrashing, doing anything to attract attention and get away. But Maya seemed to hold him with her eyes like a snake holding a bird. She was unnatural and evil†¦ but she was so beautiful. It was the first and the last time that Thierry would be fascinated by the beauty of pure evil-but it was enough. He was doomed from that moment. He'd doomed himself. An instant of hesitation. He would pay for it for unimaginable years in the future. â€Å"It's not so bad,† Maya was saying, still fixing him with her terrible and lovely eyes. â€Å"There are a few things I had to figure out-a few things I didn't expect. I thought drinking the blood of the babies would be the end of it, but no.† Thierry felt sick. â€Å"I've got these teeth for a reason, apparently. It seems I have to drink the blood of a mortal creature every day, or I die. It's inconvenient, but I can live with it.† Thierry whispered something beginning with, â€Å"Oh, Hecate, Dark Mother-â€Å" â€Å"Now, stop that!† Maya made a sharp gesture. â€Å"No praying, please, and especially not to that old harridan. I'm not a witch anymore. I'm something completely new-I suppose I should think of a name for myself. Night-hunter†¦ blood-drinker †¦ I don't know, the possibilities are endless. I'm going to start a new race, Theorn. We'll be better than the witches, stronger, faster-and we'll live forever. We'll never die, so we'll rule everyone. And you're going to be my first convert.† â€Å"No,† Thierry said. He still thought he had a choice. â€Å"Yes. I'm going to have a baby-not with you, I'm afraid; I don't think you'll be able to-and the baby will have my blood. And I'm going to give my blood to other people the way I'll give it to you now. Someday there won't be anyone in the world who won't have my blood. It's a nice thought, isn't it?† She rested her chin on a fist and her eyes glittered. â€Å"Hellewise will stop you,† Thierry said flatly. â€Å"My sister? No, I don't think so. Especially not since I'll have you to help me. She likes you, you know. It will be hard for her to kill somebody she likes so much.† â€Å"She won't have to. I'll kill you,† Thierry snarled. Maya laughed out loud. â€Å"You? You? Don't you know yourself yet? You're not a killer-you don't have the guts for it. That will change, of course, after I give you my blood. But you won't want to kill me then. You'll join me-and be happy. You'll see.† She dusted off her hands as if a difficult negotiation had been accomplished and terms had been reached. â€Å"Now. Let's do it.† He was strong. He had that good throwing arm-he was dead accurate with a spear or a killing stick. But she was so much stronger that she could handle him like a baby. The first thing she did was clamp a hand across his mouth-because by this time it had occurred even to stupid Thierry that he was in very bad trouble, and that he needed help. There was no sound of a struggle as she dragged him off into the bushes. â€Å"I'm afraid this is going to hurt,† she said. She was lying on top of him, her eyes glittering into his. She was excited. â€Å"At least, all the animals I've caught seem to have found it very unpleasant. But it's for your own good.† Then she ripped his throat out. That was what it felt like. And that was when he realized what those long canine teeth were for. Like any lynx or cave lion or wolf, she needed teeth to tear. Through the black waves of shock and pain, he heard her drinking. It lasted a long time. But finally, mercifully, he realized that he was dying. He took comfort in the thought that the horror would soon be over. He couldn't have been more wrong. The horror was just beginning. When Maya lifted her head, her mouth was scarlet with his blood. Dripping. She wasn't beautiful any longer, she was simply fiendish. â€Å"Now,† she said. â€Å"I'm going to give you something that will make it all better.† She pulled back and placed a fire-hardened splinter of wood at her own throat. She smiled at him. Maya had always been physically brave. And then, with a gesture almost of ecstasy, she plunged the splinter in, sending blood spurting and spilling. Then she fell on top of him again. He didn't mean to swallow the blood that filled his mouth. But everything was so gray and unreal-and he still had enough survival reflex left to not want to drown in it. The warm, strange-tasting liquid went down his throat. It burned like fermented-berry wine. After she made him drink, he realized to his relief that he was still dying. He didn't know that he wasn't going to stay dead. He felt her carrying him farther into the forest-he was completely limp now and didn't put up any resistance-and then everything went black. When he woke up, he'd been buried. He clawed himself up out of the shallow grave and found himself looking into the astonished face of his brother Conlan. The tribe had buried him in the traditional way-in the soft dirt at the back of the cave. In the minute before his brother could yell in surprise, Thierry was at his throat. It was animal instinct. A thirst inside of him like nothing he had ever known. A pain that was like being underwater-being strangled-gasping for air. It made him desperate, made him insane. He didn't think at all. He simply tried, mindlessly, to tear at his brother's throat. What stopped him was someone calling his name. Calling it over and over, in great pain. When he looked around, he saw Hellewise, her brown eyes huge and spilling with tears, her mouth trembling. The expression on her face would haunt him forever. He ran out of the cave and kept running. Behind him, just faintly, he could hear Hellewise's voice, â€Å"Theorn, I'll stop her. I swear to you, I'll stop her.† He realized later that it was all Hellewise could offer him. She knew that his curse was permanent. What he was now, he would be forever. There wasn't a name for it then, but he was the first made vampire. Maya, who would have a son just as she promised, was the first of the lamia, the family vampires who could grow up and have children. And her son, Red Fern, would be the ancestor of the Redfern family, the most powerful lamia family in the Night World. Thierry didn't know any of that as he ran. He only knew he had to get away from people, or he would hurt them. Maya caught up with him while he was frantically trying to quench his thirst by drinking from a stream. â€Å"You're going to make yourself sick,† she said, inspecting him critically. â€Å"You can't drink that. It's blood you need.† Thierry jumped up, shaking with fury and hatred and weakness all mixed together. â€Å"What about yours?† he snarled. Maya laughed. â€Å"How sweet. But it won't do. You need the blood of living creatures.† She wasn't at all afraid of him, and he remembered how strong she had been. He was no match for her. He turned and began to stumble off. Maya called after him, â€Å"You can't do it, you know. You can't get away from me. I've chosen you, Theorn. You're mine, now and forever. And in the end you'll realize that and join me.† Thierry kept going. He could hear her laughing as he went. He lived on the steppes for several weeks, wandering across the high windswept grasslands. He was more an animal than anything resembling a person. The thirst inside him made him desperate-until he stumbled over a rabbit. The next instant he found that he was holding it, biting into its throat. His teeth were like Maya's now-long, sensitive, and perfect for tearing or puncturing. And she was right, only the blood of a living creature could help the burning, suffocating feeling inside him. He didn't catch food very often. Every time he drank it reminded him of what he was. He was starving when he finally came to the Three Rivers. He didn't see the little girl out picking spring greens until he was on top of her. He burst out of a pile of brush, panting with thirst like a wounded deer-and there she was, looking up at him. And then everything went dark for a while. When he came to himself, he stopped drinking. He needed the food, he would die in terrible agony without it-but he dropped the girl and ran. Hana's people found him a little while later. And they did exactly what he'd expected any tribe to do-they saw that he was an abomination and brandished spears at him. He expected them to kill him at any minute. He didn't realize yet-and neither did they-that a creature like him took some killing. And then he saw Hana.
